These Terms of Service ("Terms") govern your use of the Arkansas Equipment website and your dealings with Arkansas Equipment ("we", "us", "our"). By using this site or contacting us about equipment, you agree to these Terms.
We work to keep machine listings, specifications, hours and pricing accurate, but they are provided "as is" and may contain errors or change without notice. Equipment is used unless stated otherwise and is sold subject to prior sale. A listing is an invitation to make an offer, not a binding offer of sale.
Listed prices are our asking prices in U.S. dollars and exclude freight, taxes, and applicable fees unless stated. Submitting an offer through the "Make an Offer" form does not create a contract; a sale is formed only once both parties agree in writing and any required deposit is received.
Inspection notes and photos are provided to help you evaluate a machine. We encourage buyers to inspect equipment in person or arrange a third-party inspection before purchase. Except where required by law, equipment is sold without warranty.
Payment terms, accepted methods, freight arrangements and title transfer are confirmed in writing for each transaction. Risk of loss passes as agreed in the sale documents. Buyer is responsible for freight unless otherwise agreed.
To the fullest extent permitted by law, Arkansas Equipment is not liable for indirect, incidental or consequential damages arising from use of this site or purchase of equipment. Our total liability will not exceed the amount paid for the machine in question.
